    In Byesville, Ohio, 37-year old David Wray was charged as: “a parent, guardian, custodian, person having custody or control, or person in loco parentis of a child under 18 years of age, who did create a substantial risk of the health or safety of an unidentified child, by violating a duty of care, protection or support,” a fourth degree felony.

     The charge followed an incident in which a five-year old girl was accidentally shot and severely injured while visiting her grandmother’s apartment.  The shot was fired by a four-year old boy through the ceiling of the apartment below.  Wray is accused of leaving a loaded handgun on a table where it was found by the four-year old.

    The girl was dancing in front of the television with her grandmother when the bullet came up through the floor, hitting her in the leg and side.  At the time of the report, the girl remained at the hospital in critical condition.  The boy was later released into the custody of his grandmother.
